Terms and Conditions

Application

These Terms and Conditions (“Terms”) exclusively govern your access to and use of the website, applications, APIs, and related services (collectively, the “Services”) as provided by Synduct GmbH (“Synduct”, “we”, “us”, “our”) to you.

The Terms shall apply vis-à-vis individuals, institutions, authorities, and companies that use the Services in their professional or administrative activities.

User

The Services are intended solely for use by qualified medical professionals, such as physicians, pharmacists, nurses, clinical researchers and medical students. The use of the Services by laypersons, caregivers or patients is expressly not permitted. Permitted users may only use the subscribed Services in accordance with its intended purpose as stated below.

Services

Synduct provides permitted users access to different Services. Each of such Services differ in their content and permitted usage. Before accessing and using one of the Services, you acknowledge to have read and comply with the following usage restrictions:

DR.INFO

DR.INFO is intended to be used by healthcare professionals as library tool for educational and informational purposes only.

DR.INFO is designed as a knowledge retrieval and education platform for healthcare professionals, such as physicians, pharmacists, nurses and clinical researchers. It retrieves, displays, summarizes, and organizes authoritative sources such as medical guidelines, consensus statements, peer-reviewed literature, and public drug databases. DR.INFO serves to educate and inform healthcare professionals based on newest guidelines and international drug databases, identify and summarize guideline-recommended diagnostic and treatment pathways for a given non-patient-specific clinical question, retrieve EMA SmPC data for EU-approved medicines (e.g., indications, dosing, warnings) for professional reference, generate non-patient-specific source-referenced visuals (e.g., hypertension management flow-chart) to aid patient education by the healthcare professional and interrogate specific documents (guidelines, SmPCs, consensus statements) at paragraph level with citation-anchored answers. DR.INFO does not and may not be used to analyse personal health data of patients, rank or prioritize treatment options, provide diagnostic or therapeutic recommendations, calculate doses or present outputs as action guidance at the point of care.

Without limitation, you may not use DR.INFO:

  • to make emergency medical decisions
  • for patient-specific diagnoses
  • to search or otherwise process patient-specific medical images
  • as a personalized medicine tool to customize treatment plans for individuals
  • as a tool to store, analyse or transmit the patient’s personal health data, particularly Protected Health Information (PHI)
  • as a tool to create alerts based on individual patient profiles
  • as a tool to build and personalize clinical care pathways
  • to be integrated into other software as a clinical decision support system storing and analysing electronic health records using AI to analyse patient datasets without permission of Synduct

Disclaimer: AI-Generated Output

Some Services may include content generated or assisted by artificial intelligence (AI). AI-generated content is informational only and not a substitute for independent clinical judgment, peer-reviewed literature or professional consulting. You should therefore not rely on AI-generated outputs as your only source. We advise you that AI-generated content is always subject to the input and may not always be correct. You as the user are responsible for reviewing the AI-generated output regarding its credibility and applicability towards the input in each case. We make no guarantees as to the accuracy, completeness, timeliness or suitability of AI-derived outputs for any application.

Your use of AI tools within the Services is entirely at your own discretion and risk. No warranties are provided, content is provided “as is”.

Users Accounts, Subscriptions and Paid Tiers

Users Accounts

You may be required to create an account to access certain features of the Services. You agree to provide accurate, complete, and current information during the registration process and update such information. You have the responsibility of maintaining the confidentiality of your account credentials and for all activities occur under your account. You have to notify us immediately of any unauthorized access to or use of your account.

Access Levels

Our Services provide different access levels for subscription. You can subscribe as an “Individual”, as a “Team” and as an “Enterprise”.

Billing and Payments

Subscriptions are subject to a fee and billed on a monthly or a discounted yearly basis. The exact fee and payment terms depend on your subscription. Payment for subscription is made via a third-party payment processor which you authorize during or after the ordering process to charge the subscription fee.

You shall only be entitled to offset if your counterclaims have been legally established, are undisputed or have been accepted by us. Furthermore, you shall only be entitled to retain payments to the extent that your counterclaim is based on the same agreement and have been legally established, are undisputed or have been accepted by us.

Free Trials and Promotions

We may offer trial access or promotional rates. After trial ends, regular billing begins unless you cancel beforehand. We reserve the right to modify or withdraw trial offers at any time.

Intellectual Property

All content provided on this and other websites and in apps provided by Synduct, including, but not limited to, texts graphics, images and their arrangements, software, AI models, user interfaces, and proprietary datasets, is owned by or licensed to Synduct, unless otherwise stated.

Upon conclusion of your subscription, we will grant you a personal, non-exclusive, royalty-bearing, non-transferable right to access and use the subscribed Service to the extent permitted under these Terms.

You may not use the Service to:

  • copy, reproduce, publish, distribute, modify or create derivative works,
  • sell or exploit the websites or apps provided by Synduct.
  • copy, distribute, or modify any part of the Services
  • reverse-engineer or attempt to extract any source code or models
  • use the Services to train competing models or tools

You may further not use the Services outside their intended purpose.

Web scraping, crawling, collection and extraction of content of this website, any other website and apps provided by Synduct is prohibited.

Data Use and Privacy

Please review our Privacy Policy for information on how we collect, use and safeguard your data.

Use of Query Data

By submitting queries, you grant us a worldwide, non-exclusive, royalty-free license to use, process, analyze, and share anonymized versions of your queries for research, analytical, or commercial purposes.

We may share or sell aggregated, anonymized query data to third parties, including research institutions, pharmaceutical companies, or healthcare organizations. These queries will never be linked to your personal identity.

Service Availability and Modifications

We may update the Services at any time. We may modify the Services, including adding or removing features or discontinuing free access to a feature, particularly to reflect product improvements, security or legal requirements, or material changes in underlying costs (e.g., LLM token/compute, storage, third-party licensing, exchange rates, taxes) and provided your legitimate interest does not contradict such modification.

We are not liable for any disruption of our Services or loss resulting from such updates and modifications. We are further not liable for any disruption of our Services or loss resulting from changes implemented by our partners and other third parties outside our reasonable control (e.g., a major update by our LLM provider that disrupts our system).

Force Majeure

We disclaim any liability for delayed provision or non-provision of our Service as far as such delay or non-provision a due to circumstances beyond our control or the control of the third-party right holder. This applies particularly to failure of electronic or mechanical communication features, third-party intervention, telephone- or other network problems, computer viruses, unauthorised access, theft, operating errors, fire, extreme weather conditions including flooding, acts of God or directives from public authorities, from governmental or supranational authorities, war or unrest.

Third-Party Integrations

Our Services may link to (or integrate with) third-party services. We do not control and are not responsible for third-party content, privacy practices or terms of services. The use of third-party services is at your own risk and subject to their respective terms.

Term and Termination

Your subscription will remain in force for the duration chosen when subscribing to the Service.

At the end of the term of your subscription, your subscription automatically renews for the duration of the original subscription unless cancelled (e.g. one month) before the end of the term of the subscription. The same applies with every renewed subscription term.

We may terminate your subscription with a notice period of (e.g. one month to the end of a calendar month) without cause.

Notwithstanding the foregoing, both parties may terminate the subscription for good cause. For us, good cause particularly, without limitation, subsists if you violate these Terms or misuse the Services.

We may provide notice to you via the e-mail address recorded in your account. You may provide notice to us using the following e-mail address (please insert e-mail address for extraordinary termination of the customer).

In case of early termination:

  • your account will be automatically closed and you may no longer access or otherwise use the Services upon expiry of your subscription; and
  • and provided your subscription is terminated before the end of the applicable invoicing period, we will refund any excess subscription fee upon expiry of your subscription.

Limitation of Liability

We shall be fully liable for damages in the event of intent or gross negligence, for damages resulting from injury to life, body and health, in accordance with the provisions of the Product Liability Act, to the extent that we have fraudulently concealed a defect and in case of a guarantee.

In the event of a slight negligent (einfache Fahrlässigkeit) breach of an essential contractual obligation, i.e. an obligation the fulfilment of which is essential for the proper performance of the agreement and the observance of which you may regularly rely on (Kardinalspflicht), our liability shall be limited to the foreseeable, typically occurring damages.

Liability shall be excluded otherwise. The limitation of liability set forth herein shall also apply to damages resulting from a breach of duty by our vicarious agents, legal representatives or suppliers.

Modifications to Terms

We reserve the right to amend these Terms. Changes of Terms will be notified through the e-mail address recorded in your account and the new edition will be attached thereto.

The changes to these Terms are deemed to have been accepted by you unless you have objected to these changes by no later than (e.g. two weeks) after the date at which you have received the notice of amendment. An e-mail to (please insert e-mail address for objections) shall suffice as objection.

Governing Law

You agree that these Terms and any legal action or proceeding relating to the website(s) and applications of us shall be governed by the laws of Germany. If you are no consumer, any disputes shall be exclusively resolved in the courts of Munich, Bavaria, Germany.

Right to Revocation

Medical students that act as a consumer within the meaning of sec. 13 German Civil Code (Bürgerliches Gesetzbuch – “BGB”) have the right to revocation of their subscription within fourteen days (14) without giving reasons. The revocation term is fourteen (14) days starting at the date at which the subscription has been concluded. To exercise your right of revocation you must inform us though explicit notice (e.g. letter sent by ordinary mail, fax-letter, or e-mail to please insert e-mail address) on your decision to revoke your subscription. You may use the following revocation form, however this is not required:

To meet the deadline, its shall be sufficient that you send the notice on the revocation of your subscription prior to expiry of the revocation deadline.

If you have revoked your subscription we will refund you all payments we have received from you including costs of delivery (except those incremental costs that have been caused by your selection of a delivery mode different from the cheapest standard mode offered by us) immediately, however, no later than fourteen (14) days after the date at which we have received your notice on revocation of your subscription. For such refund, we will use the same payment mode that you have used for the original subscription and for the initial payment of the subscription fee unless we have expressly agreed otherwise with you; we will in no event change any fees for your refund.

Your revocation right shall forfeit for any subscription regarding the delivery of digital contents not stored on any storage device if we have started with execution of the subscription after you (i) have expressly consented to start of execution prior expiry of the revocation deadline and (ii) have confirmed to be aware that through your approval at the start of execution of your subscription you will forego your right of revocation.
